Navigating the Security of Payment Act – Tips and Traps for Project Managers
This session will provide an overview of the Security of Payment Act (WA), with a particular focus on the statutory adjudication mechanism and the implications for project delivery. Drawing on recent case law and lessons from the Eastern States, the presenters will highlight key compliance issues and emerging risks for project managers.
Security of Payment legislation is designed to ensure timely payment practices in the construction industry. It provides important protections for contractors and subcontractors, while establishing a clear legal framework for resolving payment disputes.
Project managers will gain insights into their obligations under the Act, including the correct handling of payment claims, issuing compliant payment schedules, maintaining proper documentation, and managing tight response deadlines. Understanding these responsibilities is essential for avoiding legal pitfalls and ensuring smooth contract administration.
